The city's drought plan counts apartment, condominium association and community association pools as public swimming pools. Once drained, a public pool may only be refilled if it was emptied to fix a hazardous part or a leak. Draining itself is limited to those two reasons or excess rainwater, and only onto ground that soaks the water up. Resurfacing appears nowhere in the plan, and no official guidance says whether it qualifies.

Finish makers give temperature limits rather than seasons. Pools run by an apartment owner or a property owners association fall under a separate state law on pool yard enclosures. It requires the yard to be fully enclosed, at least 48 inches high, measured on the side away from the pool. The city's inspection form for these pools also checks for self-closing, self-latching gates, no gap a 4-inch ball could pass through, and no chain-link fencing after January 1, 1994. Those rules still apply while crews come and go.

A community pool can close after its swimming season, but Texas still wants the pool yard shut with a closed sign on the gates. An idle outdoor public pool must also be kept clear and free of algae.
