Which pools count as commercial in Texas
Texas treats any pool that isn't residential as a public pool, whether it's privately owned or not and whether or not it charges a fee. A residential pool is one used by no more than two resident families and their guests. Most of the pools on this page are Class C in the state rules: pools limited to occupants, members or students and their guests, not the general public. Class B pools are open to the general public.
HOA, apartment and condominium pools
Property owner association, apartment and condominium pools are Class C pools under state rules. The city calls HOA and apartment pools semipublic and requires a license to run one, and its drought plan treats apartment, condominium and community association pools as public ones. Texas public-pool rules for the finish and markings
The code a resurfacing follows
Texas adopts the 2021 International Swimming Pool and Spa Code for building, altering, renovating, enlarging and repairing commercial pools. That code holds pool plastering to the national plastering standard for pools and spas. Under state rules, a minor renovation or repair may follow the construction standard in place when the pool was built. Local rules may differ from the state's only by being equal or stricter.
Light finishes that don't hide the bottom
Public-pool finishes must not obscure objects or surfaces in the water, the 2021 code says. It sets a floor of 6.5 on the Munsell color value scale, where higher numbers are lighter. Waterline tiles, step and bench edge markings, lane markings and pools under 24 inches deep are among the exceptions. The newer 2024 edition, which Texas hasn't adopted for commercial pools, goes further: white or light-colored floors and walls, at least 8.0 on the Munsell gray scale.
Tile markings an inspector checks
Much of the marking work is tile, set as the finish goes on. State rules and the city's inspection form look for:
- slip-resistant, contrasting edges on stair treads, 1 to 2 inches wide, and 1-by-1 stripes on the leading edge of benches, water lounges and steps;
- in pools over 5 feet deep, a contrasting line across the floor where the shallow area turns deep, such as a row of tile at least 4 inches wide;
- permanent depth markers, with numbers at least 4 inches high, in the top 4-1/2 inches of the wall just under the coping;
- at least two depth markers per pool, no more than 25 feet apart;
- slip-resistant surfaces wherever swimmers stand.

Drain covers stay part of the job
Since December 19, 2008, every public pool has needed anti-entrapment drain covers that meet the federal standard. A pool with a single main drain that can be blocked needs a second safety system as well. The U.S. Consumer Product Safety Commission's 2024 letter to pool owners recommends replacing covers past the expiration date printed on them. Sometimes a drain's recess (the sump) has to be substantially altered to take a new cover. Then a registered design professional must approve it, or the cover's maker must document that the flow through the cover suits it. Texas bars running the pump while a cover is missing, broken or loose, and the pool stays closed until it's fixed.

Draining, closing and refilling a commercial pool in New Braunfels
The drought plan's refill limit
One drought rule applies only to public pools. The drought plan's pool rules have held year round since October 1, 2026. A pool may be drained only onto ground that soaks up water, and only to lower rainwater, to fix a part that has become hazardous, or to repair a leak. A public pool may then be refilled only if it was drained for one of the last two reasons. The plan says nothing about resurfacing, and the utility hasn't said whether it fits one of those reasons. Talk to New Braunfels Utilities before a commercial pool is emptied. A written variance request, asking for an exception to the rule, goes to its Conservation Coordinator and is reviewed within 30 days.
Where drained commercial pool water can go
State rules send a public pool's drain water to disposal under the Texas Commission on Environmental Quality's rules or local ones. There can be no hard pipe connection between the pool system and a sewer or septic system. Discharge runs through an air gap, with the pipe opening at least two pipe diameters above anything that could flood it. In the city, pool water can't go into the sanitary sewer without the utility's approval, or into a street or storm drain at all.
Closing a commercial pool to swimmers
State rules say that during a renovation, no swimmer or unauthorized person may enter the pool yard, and the entry gates must carry a sign saying the pool is closed. A pool must also close whenever its water drops below the range its skimmers or gutters work in. The city can order a pool closed on the spot for hazards such as a main drain that can't be seen, and it may reopen once the repairs are done.

How much does commercial pool resurfacing cost?
No Texas or national price for commercial pool resurfacing has been published. What moves the price is the same as on any resurfacing job. One San Antonio-area contractor lists the surface area, the repairs the shell needs and the finish. Added tile, coping or equipment work counts too, and so do features such as beach entries and spas, which take more labor. Which finish lasts longest on a commercial pool?
Among cement finishes, pebble has the longest surface life on the National Plasterers Council's figures: 12 to 18 years, against 10 to 15 for quartz. One liner maker won't promise the same life in commercial pools, citing bather load, warmer water, chemical demands and upkeep. Finish makers' warranties are shorter for commercial pools too. Diamond Brite's covers a home pool for 10 years but a commercial one for 5, and one pebble maker's 15 years residential becomes 7 commercial.
When is the best time to resurface a commercial pool?
No rule names a season, but finish makers set temperature windows. One quartz maker wants 50°F to 100°F for a day before and three days after the finish goes on. State rules ask less of an outdoor public pool that's out of use for a long stretch, such as the off-season. It must stay clear and free of algae, but the other water-quality limits needn't be met. Plan around the city's refill limit for public pools, too.
Is resurfacing a commercial pool worth it?
For a public pool, the surface bears on whether it can open. Texas lets a public pool open only when its bottom and any submerged drains are clearly visible. Its clarity test needs an 8-inch black disk on the floor at the deepest point to be clearly seen from the surface above or the nearest deck. State law also makes owners keep a public pool sanitary, with construction that keeps the chance of drowning or injury to a practical minimum.
Does a commercial pool need a city license in New Braunfels?
Yes. Running a public or semipublic pool without a city license is unlawful. The license costs $200.00 for up to two pools at one location, plus $50.00 for each additional pool there, and every license expires on December 31. The city inspects these pools to document compliance with state law, and a violation can bring a fine of up to $2,000.00, with each day a separate offense. The city's rules stop at its limits, and neither Comal nor Guadalupe County lists a pool license. Comal County's Fire Marshal may require a permit for commercial buildings, and Guadalupe County's requires a building permit to remodel a business.
